Note | Sep 1824 | In September 1824, Kiziah Wright sued William Battles for divorce in Blount County AL, claiming extreme cruelty, abandonment and adultery. In particular, she alleged that "for the last two years the said William Battles (having previously compelled your petitioner to leave him) hath lived and now is living in adultery with one Ann Jacobs with whom he has gone to the State of Tennessee". The case was continued from year to year, eventually being dismissed for want of prosecution in the April 1829 court term. There is nothing in the court records to suggest that William and Kiziah had any children together. |

The five children enumerated in this family in 1830 were undoubtedly the children of William and Ann Jacobs Battles, although William and Ann were only married in December 1829. Although the genders do not match up exactly against the census (not an unknown occurrence), four have been identified (George, Margaret, Guilford and Azariah); the fifth is unknown. |
1840 Census | 1840 | William Battles was listed as head of a household on the 1840 U.S.census of Cherokee County, AL. The identities of the known children and their estimated years of birth do not quite match up to the children recorded on the 1850 census. For example, both Julia (b c 1834) and Samantha (b c 1832) should have appeared on the 1840 census and do appear on the 1850 census. Margaret was only in her early teens in 1840 and should have appeared on the census as well. But the 1840 census indicates only one girl, under age 5. Based on age and gender, his household could have included his wife Ann Jacobs Battles, his sons Lewis and Franklin (males under age 5), his sons William and Azariah (males age 5-10), his son Guilford (male age 10-15), his daughter Julia (female age 5-10). |

The children -- "Aserier" (Azariah), age 20, Samantha, age 18, Julia, age 16, William, age 14, Franklin, age 12, Lewis, age 10 and Charlsey age 8 -- were all shown as born AL. Enumerated nearby were two older Battles children (likely born out of wedlock): "Tillford" (Guilford) Battles (household 1048) and Margaret Battles Shew (household 1055). |
