The moot court case was based on the real case of McGrogan v. Till, 167 N.J. 414 (2001), in which the primary issue was what statute of limitations should apply to a legal malpractice action and where the lower court had considered, but did not decide, whether a guilty criminal defendant could ever sue the attorney who represented him in the criminal case.
