The moot court case was based on the real case of Boy Scouts v. Dale, No. 99-699 (U.S. Sup. Ct., June 28, 2000), reversing by a 5-4 margin the decision of the New Jersey Supreme Court in Dale v. Boy Scouts, 160 N.J. 562 (1999). The case involved a gay assistant Scoutmaster challenged the right of the Boy Scouts to exclude him from membership and leadership by reason of his sexual preference. Dale won his state court challenge but lost on first amendment freedom of expressive association grounds in the United States Supreme Court.
